Breeders Agreement/Co-Ownership Contract

The following ____ Breeders Agreement _____ Co-ownership Contract between

Amber D. Smith as sole owner of Enchanted  Huskies hereinafter calledBreeder and _______________________________ hereinafter called Owner of this Enchanted  Huskies sire/dam known as _________________________, whelped ________________.

　

The co-owner may keep the bitch during breeding/whelping/nursing of puppies if they feel comfortable doing so. If not Amber Smith will take her at these times. Co-Owner must allow Amber Smith access to ___________ and her litter.

The co-owner will notify Amber Smith on first signs of every heat this female has.

The co owner will be responsible for all day to day expenses for food and care.

Co-owner will be responsible for all vet expenses.

The co-owner will be solely responsible for the actions of ___________ while in their day to day care.

The co-owner will allow Amber Smith access to ___________ for showing, special training, breeding, whelping and nursing or wellness checks on ___________. If the Co-Owner refuses Amber Smith access to ___________ at any time given with 48hr notice to co-owner, Amber Smith has the right to repossess ___________.

___________ is to live day to day with co-owner except for times stated in this contract.

Until ___________ is spayed the co-owner will keep this female away from all male dogs capable of breeding, while in season unless agreed upon by Amber Smith.

___________ is to be confined to the house when in heat except to be taken out side under strict supervision. Co-owner shall not spay ___________ without permission from Amber Smith

If co-owner wishes to enter ___________ in a show that the co-owner wants, Amber will pay the costs of that show, but the co-owner will handle the dog themselves.

When Amber sees that the dog should be retired & spayed. After completion of spaying by the Co-Owner, Amber Smith will sign ___________’s registration papers over to co-owner and Amber Smith will have no more legal right to ___________ from the day of spaying forward, {except for the abuse and neglect clause of this contract}

Amber Smith will have the right to choose the stud dog/Dams for any litters ___________ shall have.

RESPONISBILITIES OF THE CO-OWNER:

If at any time the Co-Owner cannot take care of ___________ or is moving further away (like to another state) the Co-Owner must return ___________ back to Amber Smith, unless it is after _______________ is spayed.

Co-Owner should not expect any other by financial compensation at any time for any reason other than the ones listed above from Amber Smith

Abuse and neglect clause- For the life of this dog, Co-owner will not abuse or neglect the care of ___________. At any time Amber Smith believes this dog is abused or neglected she has the right to repossess ___________ and co-owner agrees to not seek legal damages against Amber Smith or cause legal expenses.

Until this dog is spayed , if the co-owner gives or sells the dog without the permission of breeder the co-owner agrees to pay breeder $1500 (price for breeding/show rights).

BREACH OF AGREEMENT: Co-Owner shall be deemed in breach of this agreement for any of the following actions: (If this contract is breached by the Co-Owner then the Breeder has the right to repossess their dog)

Co-Owner denies Amber Smith access to ___________ for purposes of breeding, or in any way hinders or attempts to prevent such breeding. Or denies Amber Smith access to ___________ for wellness checks, or training/competing in dog events/competitions.

Co-Owner Spays ___________ without the written permission from Amber Smith.

Co-Owner fails to properly care for this sire/dam, or fails to follow any recommendations made by Amber Smith regarding the proper care of this dog.

Co-Owner has spayed ___________ without our written consent

___________ has been neglected or abused in any way

___________ expires in the care of the Co-owner due to neglect or abuse.

There is any conflict in bringing ___________ to be bred, to whelp, to be assessed, or to compete in dog events.

A failure to let Amber Smith know about a heat cycle regardless of whether or not she intends on breeding ___________ at that time.

There is any conflict in regards to the paperwork/agreement of the contract

If you move and do not notify us

Co-Owner fails to perform any of the other duties as set forth in this agreement.

DAMAGES: Amber Smith shall have the right, upon the breach of this agreement by Co-Owner, to sue for actual damages, or request equity remedies including but not being limited to regaining full ownership of ___________. In addition to such rights as Amber Smith may have by law or equity, if Co-Owner has breached this agreement, Co-Owner shall pay $1500. Co-Owner agrees to pay all legal fees should Amber Smith need to seek legal damages. Death due to abuse or negligence of ___________ in the care of the Foster Owner will also constitute breach of contract

AMENDMENT OF AGREEMENT: This agreement can be amended only by a subsequent written agreement between the parties.
